It is not "private" property, it is commonly-owned property...

Call it what you want... it's private. The HOA is a private entity, not a government entity. And the KEY is that the Constitution protects our Rights from infringement by the GOVERNMENT. Our constitutional protections do not apply in any sector outside the government.

There's no legal claim here on the basis of Constitutional Rights.
 

The HOA's rule isn't unconstitutional, since the Constitution does not apply... at all.

BUT if the police (gov't) came in to enforce the rule then the POLICE would be the ones acting unconstitutionally.

That all said, the HOA could likely levy fines or other penalties including kicking them out of the community, I suppose. But again, in any case, the Constitutional protections of our Rights have ZERO force of law when it comes to PRIVATE entities acting on PRIVATE property.

In a formal letter sent on Thursday to the Tradition Community Association, Inc., Uthmeier said the association’s policy prohibiting firearms in shared spaces conflicts with Florida statutes protecting the right to keep and bear arms. The rule applies to residents, guests, and contractors and covers common areas including parks, trails, recreation spaces, and gathering facilities.
