While I welcome any improvements, short of a SCOTUS level decision or a signed law then I am not too excited as it can all be reversed via stroke of the pen at the whim of a future (or current) administration.

Oh, but SCOTUS has already ruled that agencies like ATF cannot make rules, they can only enforce rules that congress has passed.

Even if they testify to Congress the files were deleted, there will be a back-up copy stored somewhere. Computerized records never go away.

This. All they can do constitutionally after Chevron was overturned is to remove previous rules that do not reflect laws that congress passed.
