The FPC won an injunction staying enforcement of this rule for their members. To my knowledge, that is still in effect.

How does that not violate the 14th Amendment? Equal protection under the law.

As of March 2026:
  • Pistol braces themselves are legal accessories.
  • Attaching a brace to a pistol does not automatically turn it into an NFA-regulated SBR.
  • Braced pistols are generally treated as pistols again (pre-2023 status), with no NFA paperwork required solely due to the brace.
Recent developments (around mid-March 2026) show the ATF filing in a Texas case arguing the challenge is moot because the rule no longer exists, but they also warned that they may still enforce existing NFA laws against certain configurations—specifically, braced pistols that "function as shoulder-fired rifles" (e.g., if used/modified in ways that make them effectively rifles, beyond just shouldering the brace).

This has sparked some alarm in gun communities (titles like "Pistol Braces Are Felonies AGAIN!" in videos and articles), but it's not a blanket ban or reversal. The vacated rule isn't back; the ATF is relying on pre-rule interpretations of the law rather than the struck-down framework. Most braced pistols—especially those used as intended (forearm-braced, one-handed)—remain legal without NFA issues.

Persons that are using braces as stocks and modifying pistols to be indistinguishable from an SBR are going to risk getting busted. There’s nothing new about this. FAFO.

So, HOW YOU HOLD IT is what determines the type of weapon it is?

Nobody mentions how it’s being held, that I’m aware of. This thing in TX is not about persons shouldering the brace. It's about the ATF saying they will enforce other NSF violations associated with blurring the line between a braced pistol and a SBR.

I read someplace that there were incidents of people pushing that envelope in TX so the ATF fired a warning shot across the bow. The bottom line here is the ATF has to enforce the law. Some people in the gun community think they are being clever by dancing around regulations and the law. They often end up in court.

This non-crisis appears to have been fomented by YouBoobers. It’s big nothingburger from what I was able to determine.

I make sure I am always compliant even if I don't like a rule. I also have an FFL, so pleading ignorance is not a defense. Like the IRS, once you are on their shit list, it’s permanent. They will be looking up your ass with a microscope the rest of your life.

I have 10.5" barrels on my braced AR pistols that were built in total compliance with all state and federal laws in effect at the time. They may resemble SBRs, but were built as pistols.

In order to shoot them safely, shouldering the brace is necessary for most to have any hope of hitting a target, even at close range.

So far, I have not been accosted by anyone when shooting them at the range. I think most range operators would rather my rounds impact the appropriate target, than their equipment, lighting, baffles etc...

ATF generally doesnt troll ranges looking for violators. They investigate complaints and ongoing criminal cases. And perform routine visits with FFLs. Technically, you shouldn’t shoulder a brace but just about everyone does.

One of my ranges' rules on "Public Day" is no NFA items. So no full-auto guns, SBRs, SBSs, suppressors, etc. The logic is RSOs are not to be tasked with verifying the legality of NFA arms of guests so such items are not allowed on PD. They ARE allowed at other times for member-only use and full-auto IS allowed at the plinking range at any other time. Just not on Public Day...

We DO see many "large-format" pistols with braces on PD. Technically, they could be considered NFA and/or afoul of state law but most of the RSOs pay little attention to them, myself included. There is an occasional RSO "fudd" moment, :rolleyes: but most of us don't give a shit as long as the guest is shooting safely. And that almost always involves shouldering the brace... :cool:
